Trip Planner Terms and Conditions

These terms apply to every trip request sent through the Amaboxly Trip Planner. They are written in plain English. Please read them before you tick the box on the request form.

The short version

In short

  • Sending a trip request is free. You agree to these terms by ticking the box on the request form before you send it.
  • We plan your trip and find flights, hotels, attraction tickets and transport. Your first plan arrives the same working day (clause 4), and 3 rounds of changes are included.
  • Pay nothing until it is the trip you want. The planning fee is RM 400 per trip, one fee for the whole group, children included. You pay it only when you approve our plan and our total beats the same trip booked online, and you pay it before we book.
  • If we cannot beat online prices, you pay nothing. If it is not the trip you want, you pay nothing.
  • You can check our prices yourself: send us a lower online price for the same trip within 48 hours of our plan.
  • Fair use: if you book the trip we planned, or most of it, yourself or through someone else within 30 days of our plan without paying the planning fee, the RM 400 becomes due.
  • When you pay at Amaboxly checkout, the payment gateway processing fee shown there is non-refundable.
  • Visas and travel insurance are not included. Airlines, hotels and other suppliers set their own rules, prices and availability.

The full terms below are what apply.

01Who we are

1.1

The Trip Planner service is provided by Amaboxly LLC, a limited liability company registered in New Hampshire, United States ("Amaboxly", "we", "us").

1.2

"You" means the person who sends the trip request and agrees to these terms. If you send a request for a group, you confirm that you have the group's permission to share their details with us.

1.3

You can reach us on WhatsApp at +1 603 440 9886 or by email at [email protected]. We reply on working days (clause 4.3).

1.4

You agree to these terms by ticking the box "I have read and agree to the Terms and Conditions" on the request form before you send your request. We cannot accept a request without this agreement.

1.5

Each request gets its own request number, shown on screen when you send it. Please quote it when you contact us.

02What the service covers

2.1

Based on the details you give us (your "brief"), we will:

  1. (a)prepare a day-by-day itinerary for your trip;
  2. (b)research and recommend flights, hotels, attraction tickets, and car rental or other transport;
  3. (c)send you a plan that lists each item, its price, and a comparison against publicly bookable online prices (the "price comparison"); and
  4. (d)revise the plan within the rounds of changes set out in clause 4.
2.2

Your brief includes your destinations, travel dates or month, number of travellers, budget per person, trip style and interests, halal or other dietary and religious needs, and your contact details.

2.3

Sending a request does not book anything. Nothing is booked until you approve a plan in writing and pay the planning fee. A clear "yes" on WhatsApp or by email counts as written approval.

2.4

After you approve a plan and pay the planning fee, we book the approved items. The cost of the approved items is separate from the planning fee. Before anything is booked, we tell you the exact amount for each item and how to pay it, and we book each item only after its payment is confirmed.

2.5

The service does not include visas, travel insurance, meals (unless included in a hotel rate you approve), personal spending, or anything not listed in our plan.

03The planning fee

3.1

The planning fee is RM 400 per trip. One trip means one itinerary for one group of travellers going on the same dates. The fee is the same for one traveller or a whole group, children and infants included, and it does not change with the number of destinations or the length of the trip. It is never charged per person.

3.2

Sending a request is free. You pay nothing to send a request, to receive our plans, or to ask for your 3 rounds of changes.

3.3

When the fee becomes payable. The planning fee becomes payable only:

  1. (a)when you approve a plan as the trip you want and our total beats the online total for the same trip, as set out in clause 5; or
  2. (b)under the fair-use rule in clause 6.

In every other case, you pay nothing.

3.4

You pay before we book. You pay the planning fee through the Amaboxly checkout, using the secure payment link we send you for your request number. We start booking only after your payment is confirmed.

3.5

The planning fee pays for our planning and price research. It is separate from the cost of any flights, hotels, tickets or transport.

3.6

Gateway fee. When you pay at Amaboxly checkout, the payment gateway processing fee shown there is non-refundable.

04Turnaround and changes

4.1

We send your first plan on the same working day when your complete request, together with your agreement to these terms, reaches us before 12 noon Malaysia time on a working day. Requests that reach us after that time, or on a day that is not a working day, get their first plan by the end of the next working day.

4.2

Each request includes 3 rounds of changes at no cost. One round means one set of changes sent together in a single message. Please collect all your changes before sending them.

4.3

"Working days" means Monday to Friday, excluding Malaysian public holidays.

4.4

A change to the brief itself (different destinations, dates, number of travellers, or a much different budget) is not a round of changes. We may treat it as a new request under these terms.

4.5

If we need more information from you, the turnaround time starts again when we receive it.

05You pay only for the trip you want, at a price that beats online

5.1

The rule. The planning fee becomes payable under this clause only when both of these are true:

  1. (a)you approve a plan from us as the trip you want; and
  2. (b)our total for that plan is lower than the online total for the same trip, worked out under this clause.

If it is not the trip you want, or our total is not lower than the online total, you pay nothing, unless the fair-use rule in clause 6 applies.

5.2

"The same trip" means all of the following match our plan:

  1. (a)the same destinations and the same dates;
  2. (b)the same flights (airline, flight numbers and times), the same cabin class, and the same baggage allowance;
  3. (c)the same hotels, room type, board (for example, room only or with breakfast), and cancellation terms;
  4. (d)the same attraction tickets, including ticket type, date and time slot where one applies; and
  5. (e)the same car rental or transport, including vehicle class, pickup and drop-off points, rental period, and included insurance.
5.3

"Online price" means a price that any member of the public can book on a website or app, shown in Malaysian Ringgit (MYR) including all taxes and compulsory fees, at the time we send the plan. If a site only shows another currency, we convert it using the latest middle rate published by Bank Negara Malaysia on the day we send the plan.

5.4

These prices do not count:

  1. (a)member-only, login-only or loyalty prices;
  2. (b)corporate, group or other rates that need special eligibility;
  3. (c)package prices, where items are only sold together as a bundle;
  4. (d)cashback, points, rebates, or card or bank-specific discounts; and
  5. (e)prices that have sold out, or are no longer bookable when we check them.
5.5

"Our total" means the total price in our plan for the flights, hotels, attraction tickets and transport, in MYR, including all taxes and compulsory fees. Our total does not include the RM 400 planning fee. Every plan shows our total, the online total and the planning fee separately, so you can see your full cost before you decide.

5.6

We compare totals, not single items. For each item in the plan, we take the lowest online price for the same item, from our price comparison or from evidence you send under clause 5.7. If no online price can be found for an item, we use our own price for it. The online total is the sum of these prices. Our total beats online only if it is lower than the online total. If our own price comparison shows that we cannot beat the online total, we tell you, and you pay nothing.

5.7

Checking prices yourself. Within 48 hours of the time we send you a plan, you may send us evidence of a lower online price on WhatsApp or by email. For each item, send a screenshot that shows the item details, the date and time you took it, and the final price including taxes and fees, together with the link to the page. The price must have been bookable when you took the screenshot. Please send any evidence before you approve the plan, because approving it and paying the planning fee confirms that you accept the price comparison.

5.8

Checking your evidence. We check your evidence and tell you the result within 2 working days. If we cannot open the link or match the item, we will ask you for more detail before we decide. If your evidence makes the online total the same as or lower than our total, the planning fee is not payable for that plan. If you ask for a revised plan, the same rules apply to it.

5.9

Prices checked again before you pay. Supplier prices can change (clause 7.2). Just before you pay the planning fee, we check our prices again. If a price has gone up and our total no longer beats the online total, we tell you before you pay. You can then ask for a revised plan, or stop there and pay nothing.

5.10

Evidence that does not count. We cannot accept evidence:

  1. (a)sent more than 48 hours after we sent you the plan, or after you approved it;
  2. (b)for an option that is not the same trip as defined in clause 5.2, or that uses a price excluded by clause 5.4; or
  3. (c)about visas or travel insurance, which are not part of our plan or our price comparison.

06Fair use: using our plan without paying

6.1

Sending a request is free, and you pay only when it is the trip you want. In return, you agree not to use our plan without paying for it. This is the main reason we ask you to agree to these terms before you send a request.

6.2

If the trip we planned, or most of it, is booked within 30 days of the date we sent you the plan (or, if we sent revised plans, the last one), and you have not paid the planning fee, the RM 400 planning fee becomes due. This applies whether you book it yourself or someone else books it for you, for example another travel agent, a friend or a family member.

6.3

"Most of the trip" means either:

  1. (a)the same outbound and return flights as our plan, together with the same hotel or hotels for more than half of the nights in our plan; or
  2. (b)items from our plan that together make up more than half of our total (clause 5.5).
6.4

When this clause does not apply. The planning fee does not become due under this clause if:

  1. (a)our total did not beat the online total under clause 5, whether our price comparison, your evidence under clause 5.7 or our price check under clause 5.9 showed it. You are free to book the cheaper option; or
  2. (b)the item was already booked before you sent us your request.
6.5

Before we ask you to pay. If we believe the fee has become due under this clause, we will tell you in writing and explain why, and you can reply before we ask you to pay. You pay it through the Amaboxly checkout, and clause 3.6 applies to the gateway fee.

07Bookings, suppliers and prices

7.1

Flights, hotels, attraction tickets, car rental and transport are provided by third-party suppliers. Every booking is subject to that supplier's own terms, including fare rules, change and cancellation fees, check-in rules, and driver age and licence requirements.

7.2

Prices and availability are set by suppliers and can change at any time until a booking is confirmed. The prices in our plan are the prices we saw when we sent it. We cannot hold a price or a seat for you.

7.3

We are not responsible for changes made by suppliers or events outside our control, such as schedule changes, cancellations, overbooking, closures, strikes, weather, or price increases. Where we can, we will help you understand your options with the supplier.

7.4

Refunds and changes for bookings follow the supplier's rules, not these terms.

7.5

If a price in your approved plan goes up after you have paid the planning fee but before we can book it, we tell you before we book. You can accept the new price, ask us for another option, or cancel. If our total no longer beats the online total and you cancel, clause 10.3 applies.

08Your part

8.1

Please give us accurate details. Traveller names must match passports exactly.

8.2

You are responsible for checking that every traveller has a passport valid for the trip (many countries require at least 6 months of validity), any visas or entry permits needed, and any health requirements. We recommend travel insurance for every trip.

8.3

Please read each plan carefully before you approve it. Approval confirms that the dates, names and items are correct.

8.4

Halal needs. When you ask for it, we look for halal-certified or Muslim-friendly food, hotels and prayer spaces. Certification is issued by third parties and can change, so please check the status yourself before you rely on it. We will say clearly when a place is Muslim-friendly but not certified.

09Your personal data and passport details

9.1

We only ask for passport details when they are needed to make a booking you have approved. Please do not send them with your trip request.

9.2

We use your personal data, including passport details, only to plan your trip and make the bookings you approve. We share it only with the suppliers who need it for those bookings (for example, the airline or hotel).

9.3

We never sell your data and never use your passport details for marketing.

9.4

We keep passport details only as long as needed for your trip and delete them within 30 days after your trip ends, unless the law requires us to keep them longer.

9.5

When you send a request, we keep a record of your agreement to these terms: the version you agreed to, the date and time, your IP address and your browser's user agent. We keep it with your request as evidence of what was agreed.

9.6

We handle personal data in line with applicable data protection law, including Malaysia's Personal Data Protection Act 2010 where it applies. See also our Privacy Policy.

10Cancelling the planning service

10.1

You can cancel your request free of charge at any time before you approve a plan and pay the planning fee. Just tell us on WhatsApp or by email. If you later book the trip we planned, or most of it, the fair-use rule in clause 6 still applies.

10.2

Once you have paid the planning fee, it is not refundable, because the planning is complete, except as set out in clause 10.3. Cancelling or changing the bookings themselves follows each supplier's rules (clause 7.4).

10.3

We refund the planning fee if, after you have paid it:

  1. (a)a price goes up before we can book, our total no longer beats the online total, and you choose to cancel (clause 7.5); or
  2. (b)we cannot book the approved items, for example because they sell out before we can book them, and you do not accept the other options we offer.

The payment gateway processing fee is not refunded (clause 3.6).

11Our responsibility

11.1

We plan with reasonable care and skill.

11.2

To the extent the law allows, our total responsibility to you for the planning service is limited to RM 400, the planning fee for one trip, whether or not the fee has become payable.

11.3

Nothing in these terms takes away any rights you have under consumer protection law that cannot legally be excluded.

12Changes to these terms

12.1

We may update these terms from time to time. The version you agreed to when you sent your request applies to that request, including every plan, change and payment for it. Each version shows its version number and date at the top of this page.

13Governing law and disputes

13.1

If you are unhappy with our service, please contact us first. We will try to resolve it with you directly.

13.2

These terms are governed by the laws of the State of New Hampshire, United States, and the state and federal courts in New Hampshire have jurisdiction over any dispute about them.
